• if such notice is received fewer than 4 days before the first date of operation, then 65% of the Charter Price
• if such notice is received fewer than 48 hours before the first date of operation, then 90% of the Charter Price
• if such notice is received fewer than 24 hours or no notice is received prior to the scheduled time of first operation, then the greater of (a) 100% of the Charter Price and (b) the total costs incurred by the Agent (as determined by the Agent).
